Please read these terms and conditions carefully before you start to use our services. These Terms and Conditions (“Terms“) contain information about your legal rights, remedies, obligations and are a legally binding agreement between you (“Customer” or “User“) and HEALTH LIFE LONDON LTD (“We” or “Our” or “HEALTH LIFE LONDON“) regarding your use of HEALTH LIFE LONDON’s Services. These Terms should be read in conjunction with our Website Terms of Use, which can be accessed here.
THE WEBSITE AND SERVICES ARE NOT SUITABLE FOR EMERGENCY TREATMENT. IF YOU HAVE A HEALTH EMERGENCY, CONTACT WITH LOCAL HEALTHCARE PROFESSIONALS OR PUBLIC HEALTHCARE SERVICES.

- INFORMATION ABOUT US
1.1 We are HEALTH LIFE LONDON LTD, a company incorporated in the United Kingdom under company number 14826882, with its registered office at 9 Walton Road, Oldbury, B68 9BZ, United Kingdom.
1.2 According to the Terms of Service, HEALTH LIFE LONDON provides health tourism services in Turkey and other countries to its customers all over the world.
- DEFINITION
2.1 The Customer is defined as the party named in the Price Proposal requesting health tourism services from us (or being requested health tourism services on their behalf);
2.2 The Healthcare Service Provider refers to a healthcare service provider including but not limited to hospitals, clinics, doctors, caregivers, rehabilitation/physiotherapy centers, dialysis clinics, healing centers, spa centers, pharmacies or e-pharmacy, laboratory services, health tourism agencies / intermediaries or diagnostic centers.
2.3 The Content refers to any content including but not limited to the Content provided in direct responses to your questions or posts, and on the website blog, as well as any text, data, graphics, images, photographs, video, audio, information, suggestions, directions and other materials made available, accessed or otherwise available through the Services and/or the Website.
2.4 The Customer refers to the Website visitors or users and/or persons who directly/indirectly contact with HEALTH LIFE LONDON in order to obtain information about Healthcare Service Providers or Third Party Service Providers. Unless explicitly stated otherwise, a reference to a Customer is deemed to include a reference to a Customer’s relatives/guardian or authorized representative.
2.5 Healthcare Services refer to healthcare, medical, surgical, therapeutic or other services to be provided by the Healthcare Service Provider.
2.6 Intellectual Property Rights refer to copyrights, trademarks, service marks, trade dress, trade secret, publicity rights, database rights, patent rights and any other intellectual property rights or proprietary rights recognized by law.
2.7 Services refer to the services provided by HEALTH LIFE LONDON defined below.
2.8 Third Party Service Providers refer to any companies that provide complementary or ancillary services, including but not limited to home nursing care, accommodation and transportation.
2.9 User refers to the Website visitor who creates a User Account to request services from Healthcare Service Providers and Third Party Service Providers or to add content to the Website. Unless explicitly stated otherwise, a reference to a User is deemed to include a reference to a User’s relatives/guardian or authorized representative.
2.10 User Data refer to any data you upload or submit to the Website or other fields of the Services.
2.11 Visitor refers to any person who accesses and uses the Website to request information about Healthcare Service Providers and Third Party Service Providers, who can use the services without creating an account.
2.12 The Agreement is defined as the document consisting of the Accepted Price Proposal and these terms and conditions, which becomes valid upon the acceptance of the terms by both parties;
2.13 The Price Proposal is defined as a written price offer indicating the costs of services given to the Customer to be approved by HEALTH LIFE LONDON;
2.14 Prices refer to any fees charged to the Customer for Healthcare Service by the Healthcare Service Provider.
2.15 Services are defined as the following services;
2.16 Website means HEALTH LIFE LONDON’s website located at the following address: https:// healthlife.com.tr/;
2.17 A Business Day is defined as any weekday between Monday and Friday, excluding days designated as public holidays in the United Kingdom, in particular Saturday and Sunday. You can access information services 24/7 via phone and WhatsApp.
In this Agreement, (unless otherwise required by the context):
a. References to singular terms also include references to plural terms, and references to plural terms also include references to singular terms, reference to any gender includes reference to all other genders.
- Reference to natural persons also includes reference to legal persons;
- Any reference to legal provisions shall be deemed to include reference to any amendment or reissuance of provisions currently in effect (whether before or after the date of this Agreement) and any reference to any legal document and instruction issued pursuant to legal provisions;
- A reference to any Article, Paragraph, Appendix or Annex shall be deemed a reference to such Article, Paragraph, Appendix or Annex of this Agreement.
- PROVISION OF SERVICES
3.1 As an intermediary company, HEALTH LIFE LONDON shall provide healthcare, travel, accommodation and transportation services to the Customer.
3.2 As the intermediary party, HEALTH LIFE LONDON shall mediate in the provision of health services, travel, accommodation and transportation services to the Customer who has completed the age of 18. If the Customer is under the age of 18, the presence of a guardian is mandatory. The Customer must sign an authorization document in order to authorize all transactions to Health Life London. Accommodation and transportation expenses of Customers under the age of eighteen shall be invoiced separately.
3.3 The Customer is responsible for accurately and clearly explaining his or her health history to HEALTH LIFE LONDON by filling out the medical form on the website with health information.
3.4 If the Customer is a minor, it is obligatory to provide contact details that can be used to communicate with the representatives of the minors directly.
3.5 Healthcare Service Providers and Third Party Service Providers promote various packages through the website. These packages may be in the form of a medical package, a travel package, or a combination of both, such as:

– Medical Packages
– Dental Health Packages
– Hotel Accommodation
– Airport Transfer
– Cosmetic Surgery Packages
– Laboratory Test Packages
– Medical Spa Packages
3.6 Healthcare Service Providers or Third Party Service Providers enumerate various medical services to promote on their website. These may include services such as:
– Nursing Care
– Home Health Care or Home Check-up
– Private Healthcare Service / Doctors on Call
– Dialysis Treatment
– Online Pharmacy
– Health Insurance / International Health Insurance
– Laboratory Tests
– Telemedicine / Telehealth
– Medical Equipment Rental
– Medical Spas
– Ayurveda Treatment
3.7 The website lists various services offered by Third Party Service Providers as follows:
– Welcoming at Airport
– Car Rental
– Accommodation reservation
– Travel insurance
– Currency Exchange
– Sightseeing Tours
– Flight Booking – specific airlines or travel portals
– Hotels
– Meal Services
– Flower/Gift Services
– International Sim Cards

3.8 The list of services above is not exhaustive, and HEALTH LIFE LONDON reserves the right to add or remove a certain service type or service group at any time. Exact details about the services provided at any given time can be found in certain sections of the website.
3.9 In accordance with this Agreement, HEALTH LIFE LONDON grants the Healthcare Service Provider a limited, non-exclusive license to use the website and services for commercial purposes. To the extent permitted by applicable law, this granted use license is non-transferable. The Healthcare Service Provider may not copy, decompile, reverse engineer, create the source code, attempt to access the source code, modify or create derivative works on the website or its content (except as expressly permitted by this license and other applicable terms and conditions or usage rules), The Healthcare Service Provider is responsible for keeping the password, login name/user ID and account information confidential at all times, and is also directly responsible for anyone’s use of the website using their login information and password, with or without their consent.
3.10 HEALTH LIFE LONDON lists Healthcare Service Providers and Healthcare Services on its website, allowing Customers to access a Healthcare Service Provider with details of the Healthcare Services needed. The Health Service Provider may offer the determined facilities and health services and treatment to the Customers using the website, including health checks, diagnosis, analysis, examination, surgery, mediation in health and travel services, preparation of drugs in lower and upper specialization areas. The Healthcare Service Provider can list special packages or give discount codes on the website, and the Healthcare Service Provider ensures that these packages are carried out appropriately and discount codes are to be applied. The Healthcare Service Provider ensures that HEALTH LIFE LONDON is notified when packages expire.
- RESTRICTED USERS
4.1 The Customer or User agrees not to use the website or services in a unlawful, violating, unfair or harmful way, so as to infringe the intellectual property, privacy or other rights of another party or in any way that otherwise interferes with the operation, use or enjoyment of any service, system or other property.
4.2 Without limiting any of the foregoing, Customers and Users agree that they shall not (and shall not allow any third party to do) do the following actions:
– Make a false application;
– Use the website for any illegal, unlawful or prohibited purpose or promote or support any illegal activity, including but not limited to copyright infringement or computer exploitation;
– Remove any copyright and other registered trademark statements contained in any content on the website;
– Carry out any activity harmful to the website as determined by HEALTH LIFE LONDON;
– Post any information, image or content that is obscene, sexually explicit or nude, indecent, defamatory, hateful or intolerant, or that violates the law in any jurisdiction;
– Introduce yourself as someone else or as a representative of a business or institution that you do not represent, or create the impression that the posts were sent by a healthcare professional although they are not;
– Make false statements about your professional or company references or professional background;
– Modify or copy or make available to the public, perform or distribute the Content in any capacity, or use the Content for any other public or commercial purpose other than as permitted herein;
– Use any automated text or “robots” to access, copy or modify any content on this site;
– Carry out denial of service attacks on servers that publish this website;
– Encourage or incite violence;
– Encourage or incite discrimination (including but not limited to discrimination based on race, gender, religion, nationality, disability, sexual orientation or age);
– Breach any legal obligation assumed to a third party, such as a contractual obligation or obligation of confidentiality;
– Register multiple accounts or create alternative accounts;
– Take any action that in our opinion may be harmful to the health or well-being of another Customer;
– Advertise and promote any products or services on the website or use the site for commercial purposes.
– Access any Content or any portion of the website and/or Services for the purpose of creating or populating a searchable comment or other healthcare industry Content or database of Healthcare Service Providers;
– Intentionally or fraudulently misuse the Services, including but not limited to making an appointment with a Healthcare Service Provider or Third Party Healthcare Service Provider that you will not attend; and
– Create user accounts, ask questions, make appointments or present shared information by automated means or false statements.
- FEES AND PAYMENTS
5.1 HEALTH LIFE LONDON will act as an agent providing aesthetic, cosmetic, ENT, dental health, hair transplantation, general surgery or general health services, accommodation, travel and transportation services to the customer, and directing the customer to the clinic and/or healthcare providers where healthcare services will be provided under this Agreement. The Customer pays 30% of the offered package price to the Health Life London debit/credit card account for the said health and tourism services.
5.2 The Customer is obliged to make the payments as specified in this Agreement. The Customer shall bear the responsibility for delays caused by himself/herself. If such delays result in any additional costs or liability for HEALTH LIFE LONDON, the Customer must promptly reimburse HEALTH LIFE LONDON for such costs.
5.3 The customer is responsible for covering the costs of free transfers to the agreed facility and mandatory accommodation if required.
- CONTENT SUBMITTED BY USERS AND CUSTOMERS
6.1 The Customer or User is solely responsible for the Content or User Data made available on the website or through other communication tools, and such presentations are at the Customer’s risk. We disclaim any responsibility or liability for any Content or User Data submitted by Customer. Customers may submit Customer experiences, and HEALTH LIFE LONDON may, at its sole discretion, publish such Customer experiences on its website. HEALTH LIFE LONDON shall verify the content of such experiences and may extract sensitive information therefrom. Experiences can also be used internally.
6.2 Any Intellectual Property relating to the processes, methodology and expertise involved in the performance of an Agreement is owned by HEALTH LIFE LONDON. Nothing in any Agreement provides assignment of the Intellectual Property of HEALTH LIFE LONDON to the Customer.
- INTELLECTUAL PROPERTY
7.1 All Intellectual Property Rights to the Website and all of its Content, features and functionality (including but not limited to any information, software, code, algorithms, database, text, images, pictures, video and audio, and their design, selection and arrangement) belong to HEALTH LIFE LONDON, its suppliers and licensors, and all rights of HEALTH LIFE LONDON not expressly granted to you in this Agreement are reserved.
7.2 In accordance with this Agreement, HEALTH LIFE LONDON grants the Healthcare Provider a personal, limited, non-exclusive license to the Customer or User to use the website and services for your non-commercial purposes. To the extent permitted by applicable law, this granted use license is non-transferable. You may not copy, decompile, reverse engineer, create the source code, attempt to access the source code, modify or create derivative works from the website or its content (except as expressly permitted by this license and other applicable terms and conditions or usage rules).
- CONFIDENTIAL INFORMATION
8.1 The Parties agree that Confidential Information is sensitive.
8.2 No Confidential Information may be disclosed by the parties except in the following cases:
- disclosure to managers, employees, contractors or subcontractors if necessary to conclude the Agreement;
- disclosure made with the express prior written consent of the other party; or
- disclosure to their professional consultants.
- CUSTOMER’S REPRESENTATIONS AND COMMITMENTS
9.1 The Customer and User represents and warrants to HEALTH LIFE LONDON that:
a. The Customer has not and shall not offer anything to HEALTH LIFE LONDON or its website that may interfere or will interfere with the operation of HEALTH LIFE LONDON’s systems and/or the website; the Customer shall not use anything (whether it is a device, software or something else embedded in the Source Materials) that may interfere or will interfere with the operation of the website, the systems of HEALTH LIFE LONDON and/or the operation of the website in terms of use of the Services or in connection with HEALTH LIFE LONDON; and
b. The Customer has the authority and ability to enter into this Agreement and fulfill its obligations hereunder.
9.2 The Customer indemnifies HEALTH LIFE LONDON for any damages, costs (including court costs incurred on the basis of a lawyer and their client), expenses, claims or liabilities in contract, tort (including omission), equity or otherwise, whether direct, indirect, consequential or otherwise, arising from a request by a third party, where the claim results from the Customer’s breach of the statements and commitments set forth in this article 9.
9.3 The Customer acknowledges, declares and undertakes that he/she has provided correct identity and contact information, and that he/she has no health and/or travel restriction. The Customer is obliged to sign the patient consent form for health care, using his/her full and correct name, without using a pseudonym, as in official records. The Customer acknowledges, declares and undertakes that HEALTH LIFE LONDON has no liability in case of false information, and that in case of any damage to HEALTH LIFE LONDON due to false information, the Customer shall immediately and without delay indemnify the said damage. The Customer acknowledges, declares and undertakes that he/she can be contacted with through the given contact information. The responsibility of any missing information and documentation given by his/her belongs to the Customer himself/herself.
9.4 By accepting this Agreement, the CUSTOMER acknowledges, declares and undertakes not to publicly criticize or attack HEALTH LIFE LONDON or any of its employees, affiliates or partners regarding the Service Provider’s treatment and transactions at any commentary blog websites, social media networks, blogs, public forums, etc. The Customer acknowledges, declares and undertakes that HEALTH LIFE LONDON cannot be held responsible for any services, medical treatment and transactions provided by the Service Provider. Therefore, the Customer agrees not to disparage HEALTH LIFE LONDON or engage in behavior that could adversely affect its reputation, services or management during or after the agreement. In case of violation of this provision, the Customer agrees to remove and delete the content immediately after HEALTH LIFE LONDON’s evaluation.
9.5 The Customer may not circumvent HEALTH LIFE LONDON to make arrangements in their own name or on behalf of another person by contacting the company or persons providing the medical services directly. The Customer may not disclose the text message, phone call, speech and video exchange between him/her and HEALTH LIFE LONDON on any platform or anywhere without the written consent of HEALTH LIFE LONDON. Otherwise, the Customer agrees, declares and undertakes to pay a penalty of £1,000.00 in a lump sum and at once in addition to any and all damages.
9.6 The Customer agrees and undertakes that the services provided by HEALTH LIFE LONDON are an intermediary service, and that the actual Service Provider is responsible for any possible disputes regarding difficulties encountered during the intermediation services provided under this Agreement, such as hospital arrangements, physician, transportation and accommodation arrangements.
- COMMITMENTS OF HEALTH LIFE LONDON
10.1 HEALTH LIFE LONDON undertakes that it has the authority and ability to enter into this Agreement and fulfill its obligations hereunder.
10.2 Unless otherwise stated in these terms and conditions, any and all warranties, terms and conditions (including but not limited to the warranties and conditions of fitness for purpose and merchantability), whether express or implied by law, common law or otherwise, HEALTH LIFE LONDON is excluded from the scope of this Agreement to the fullest extent permitted by law.
10.3 While we make reasonable efforts to provide accurate content, we make no warranties, representations or guarantees of any kind, express or implied, as to the accuracy of information provided by customers or other content made available through the services. We are in no way liable to you or anyone else for any decision or action taken by you based on the content in question.
10.4 The website and the services offered on the website are presented as “available”, not “latest up-to-date”. HEALTH LIFE LONDON disclaims any and all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, safety and accuracy, and any warranty of any kind arising from trade practice, elimination of ambiguity, or performance.
10.5 Without limiting the foregoing, HEALTH LIFE LONDON makes no commitments and expressly disclaims any liability in this regard: (1) The website is to be up-to-date, complete, comprehensive, accurate or relevant to your situation, (2) the website of the SERVICE is to meet your needs or be accessible uninterruptedly, on time, securely or without errors, (3) the results that can be obtained from the use of the website or the services offered through the website is to be accurate and reliable, (4) the quality of the products, services, information or other materials you obtain on the website is to meet your expectations.
10.6 HEALTH LIFE LONDON shall not be responsible for requests from advertisements appearing on our site.
- LIMITATION OF LIABILITY
11.1 Even if the representative of one of the parties (including officers, directors, employees, representatives, affiliates, partners and suppliers) has been notified that such damages may occur, HEALTH LIFE LONDON shall not be liable for any injury, death, damage, claim, natural disaster, accident, delay or any direct, special, exemplary, punitive, indirect, incidental or consequential damages (including but not limited to lost profits or savings), whether based on contract, intentional act, strict obligation or otherwise. In no event shall HEALTH LIFE LONDON’s total liability under this agreement exceed £300 (three hundred pounds). HEALTH LIFE LONDON shall only be liable for direct damage (excluding loss of business or profits and excluding all consequential damages) up to a maximum of £300 (three hundred pounds).
11.2 Without limiting the foregoing, HEALTH LIFE LONDON cannot be held liable or responsible for any delay, default, lack of improper service(s) and/or injury, illness, accident, sickness, death or any kind of damage, that may arise due to carelessness or inadequacy or negligence in the services of Healthcare Service Providers and another Third Party Service Provider’s management or employees.
11.3 The customer agrees, declares and undertakes that HEALTH LIFE LONDON does not have any legal obligations other than intermediation in terms of the health services provided to him/her, and that he/she shall not hold HEALTH LIFE LONDON retroactively responsible for any material or moral damages arising from healthcare services. He/she also agrees that he/she shall not claim any compensation from HEALTH LIFE LONDON to cover damages caused by healthcare services. The Customer also agrees and declares to receive all these services from HEALTH LIFE LONDON as an intermediary institution.
11.4 The Customer agrees and declares not to act contrary to this article and accepts that the Service Provider is responsible for medical services and additional services that are not under the responsibility of HEALTH LIFE LONDON. The Customer does not take any adverse action against HEALTH LIFE LONDON due to dissatisfaction with the medical services provided, otherwise the Customer is liable to pay a penalty equal to the fee paid.
11.5 Prior to the entry into force of this Agreement, HEALTH LIFE LONDON recommends the Customer to take out insurance against possible risks related to material or non-material damages that may occur during the transaction to be made under the Agreement and during the Customer’s accommodation or transportation.
11.6 HEALTH LIFE LONDON cannot be held liable for any damages resulting from non-performance or improper performance of the Agreement due to force majeure or unforeseen circumstances. Force majeure circumstances, by legal definition, including those outside the control of HEALTH LIFE LONDON, which prevent the commencement, continuation or termination of this Agreement, if all measures have been taken, are considered force majeure.
- THIRD PARTY PARTNER
12.1 HEALTH LIFE LONDON may establish partnerships with various third parties regarding the provision of the Services, and its website may contain links and hyperlinks to third party sites. Please carefully read the Terms of Service and Privacy Policies of the sites in question before using them. Use of such third party sites is at your own risk.
12.2 Any purchase by Customer for a third party service shall be made directly with the Third Party Service Provider. Any questions or requests regarding third party service(s) should be directed directly to the Third Party Service Provider. The list of third party service providers on the website does not constitute and should not be construed as a recommendation or endorsement of the quality, service level or competence of any third party service provider.
12.3 You agree that HEALTH LIFE LONDON is in no way responsible for the accuracy, timeliness or completeness of information it may receive from such third parties. HEALTH LIFE LONDON shall not be liable for bodily harm, death, loss of property or other damages or expenses arising from the acts, omissions, errors, representations, warranties, breaches or omissions of such third parties, your interactions with such third parties, or the services you receive from such third parties.
- WEBSITE TERMS
13.1 The website helps Customers to find and contact Service Providers and Third Party Service Providers. Customers can also use the website to ask questions to Healthcare Service Providers.
13.2 HEALTH LIFE LONDON does not require and does not request, control, store or otherwise process any medical or health information regarding Users or Visitors. If you provide us with personal information, whether health-related or not, you agree that HEALTH LIFE LONDON may only share such information with the Healthcare Service Provider or Third Party Service Providers you have chosen to provide the Services. The personal information you provide shall be treated according to our Privacy Policy.
13.3 The website may show you sponsored results, including above search results (“Sponsored Results”). HEALTH LIFE LONDON charges Healthcare Providers additional fees for submission of Sponsored Results. Sponsored Results displayed through the Website are not the endorsement or recommendation of HEALTH LIFE LONDON and should not be construed as such. HEALTH LIFE LONDON does not otherwise recommend or endorse specific Healthcare Providers or Third Party Service Providers, but provide information on their location, accreditation, number of beds, specializations. Before making use of Healthcare Services or other services, you perform your own research and comprehensive examination.
13.4 The Healthcare Service cost is between the Customer and the Healthcare Service Provider. Prices offered by Healthcare Service Providers to Customers are estimates only and may differ from actual cost depending on the actual condition of the patient, as well as fees required for treatment due to other factors, including over-admissions or other complications. HEALTH LIFE LONDON cannot be held responsible for quotes from Healthcare Service Providers. Any insurance and insurance-related content is provided for general reference purposes only. It is the Customer’s responsibility to work with a suitable insurer. HEALTH LIFE LONDON shall not be held liable for incorrect, incomplete or outdated insurance-related Content found on the Website.
13.5 It is the Healthcare Service Provider’s responsibility to ensure that the profile, list of doctors and doctor profiles are up-to-date, and HEALTH LIFE LONDON shall not be liable for any incorrect, incomplete or outdated profile information of a Healthcare Service Provider.
13.6 While some content may be provided by healthcare professionals, you agree that the provision of such content does not create a healthcare professional/patient relationship, opinion, medical advice, diagnosis or treatment between you and HEALTH LIFE LONDON or the Healthcare Service Provider.
13.7 Website content of HEALTH LIFE LONDON, its employees, contractors, partners, sponsors, advertisers, licensors or through the Services is for informational, programing and payment purposes only. All medical information, including but not limited to the information shared on the blog, articles by independent healthcare professionals and organizations, and articles by other third-party bloggers, is for informational purposes only and does not constitute medical advice, opinion, diagnosis or treatment.
- TERMINATION
14.1 HEALTH LIFE LONDON reserves the right to terminate this Agreement unilaterally in good faith. In case of termination by HEALTH LIFE LONDON, the amount paid by the Customer shall be refunded, except for mandatory taxes, fees and similar expenses arising from legal obligations, as well as any documentary and non-refundable expenses paid to third parties. In addition, the cancellation and change rules of the companies regarding the previously purchased plane, train and cruise tickets and accommodation costs shall be applied as they are. The Customer, i.e. the passenger, shall be responsible for any applicable penalties.
14.2 For refunds to be made through a bank, the bank transfer fee shall rest with to the Customer. HEALTH LIFE LONDON cannot be held responsible for delays in refunding payments made by credit card.
14.3 In the event that either party violates this Agreement, the non-violating party may request the correction of the violation with a written notification sent through a notary public within 7 (seven) business days. If the violation is not remedied within the granted time, the non-violating party has the right to terminate the Agreement.
14.4 HEALTH LIFE LONDON has the right to assign this Agreement, in whole or in part, to real and legal persons with whom it has a contractual relationship for the performance of this Agreement. In such a case, the successor of the transferred parts is the relevant actual or legal person.
14.5 The Customer does not have the right of withdrawal or termination unless they present a complete and acceptable, certified and valid medical report explaining the reasons for not being able to receive health care for another medical reason. In such conditions, withdrawal or termination is valid only if the notification is served in writing. HEALTH LIFE LONDON reserves the right to deduct and/or defer the refund fee by deducting an administrative fee of £150 (one hundred and fifty British Pounds).
14.6 If the Customer exercises its right of termination pursuant to article 15.5, the termination shall take effect from the date on which the Customer’s written notice of termination is served on HEALTH LIFE LONDON. The amount of fees payable shall depend on when the notice of termination is served. However, the termination fee shall always be limited to actual costs and payments made. In the event of termination, the Customer’s deposit shall be retained as the reservation fee.
- RESOLUTION OF DISPUTES
15.1 When a dispute arises between the parties as a result of a contract or the conditions, statements or conduct giving rise to the Agreement, neither party may bring any action or initiate an arbitration proceeding unless the relevant party takes the actions set forth in this article 17.
15.2 The party initiating the dispute (the “first party”) must provide written notice of the dispute to the other party (the “other party”). The notice should indicate that the representative of the first party has been appointed for negotiations. The other party is obliged to serve written notice to the first party within seven days of receiving the notification stating its representative for negotiations. Each appointed representative shall have the authority to resolve the dispute.
15.3 If the parties fail to resolve the dispute by consideration and negotiation within 14 days of receipt of the first party’s written notice, the parties may refer the dispute to the Court of England and Wales.
- GENERAL AND OTHER PROVISIONS
16.1 Entire agreement: Each Agreement constitutes the full and sole expression of the agreement between the parties and supersedes any prior proposal or agreement between the parties, whether oral or written, relating to the subject matter of that Agreement.
16.2 Amendments: Unless explicitly stated, no amendment to an Agreement shall be effective unless in writing and signed by both parties.
16.3 Waiver: The exercise or failure, or delayed exercise of any right or remedy by any party shall not constitute a waiver by such party of that or any other right or remedy.
16.4 Partial invalidity: If any provision of an Agreement or its application to any party or situation is to any extent invalid or unenforceable, the remainder and application of the Agreement shall not be affected and shall continue to be enforceable to the fullest extent permitted by law.
16.5 Independent Contractor. HEALTH LIFE LONDON is an independent contractor of the Customer and remains independent of the Customer in all respects. Nothing in any Agreement makes either party a partner, agent, employee or joint venturer of the other.
16.6 Suspension: HEALTH LIFE LONDON may suspend performance of its obligations under an Agreement if it becomes unable to perform for reasons beyond its control.
16.7 Assignment: The Customer may not assign its rights under the Agreement without the prior written consent of HEALTH LIFE LONDON.
16.8 Severability: If any provision of an Agreement is found to be invalid or unenforceable for any reason, the Agreement shall continue in effect, except for such provisions, which are to be deemed deleted.
16.9 Predominance: In the event of any conflict or inconsistency between these terms and conditions and the Accepted Price Proposal, these terms and conditions shall prevail unless otherwise stated in these terms and conditions.
16.10 Force Majeure: HEALTH LIFE LONDON shall not be liable for late performance or non-performance of its obligations due to natural disasters, earthquake, labor disputes, changes in laws, regulations or government policy, riots, war, fire, flood, uprising, sabotage, embargo, epidemics, pandemics, acts or omissions of vendors or suppliers, transportation difficulties, lack of telecommunications or third-party services, interruption or delay, failure of third-party software or hardware, or failure to obtain raw materials, materials or electricity or equipment needed. HEALTH LIFE LONDON is not responsible for server downtime under any circumstances.
16.11 Children aged 0-6 are not provided with separate beds in hotel accommodation. Children over the age of 2 are subject to a fee as they must be given a seat in the transportation vehicles.
16.12 The Customer is responsible for tracking and controlling his/her personal belongings during the service period, and HEALTH LIFE LONDON is not responsible for any lost / stolen / damaged items. HEALTH LIFE LONDON is not responsible for lost items and incidents involving third parties such as hotels and transfers.
16.13 HEALTH LIFE LONDON reserves the right to make any necessary adjustments or cancellations in programs, accommodation facilities and transportation vehicles due to force majeure or operational reasons. In such a case, the reservation owner’s approval is not required, and there is no right of termination or compensation.
16.14 During the signing of this Agreement, the Customer has been specifically warned and informed that the departure time or type of aircraft may change due to reasons arising from the airline company, and the customer has accepted this situation.
16.15 The accommodation facility requires a visa for international travel, including infants, depending on the country of destination with the passport. The Customer agrees and declares that he/she has been warned by HEALTH LIFE LONDON regarding this issue.
16.16 All additional service fees other than the type of accommodation specified under this Agreement are paid in cash by the Customer when leaving the hotel.
16.17 The Customer must be present at the meeting point 30 minutes before the departure time for road transport and 2 hours before the departure time for air transport.
16.18 Pets are not allowed on the transportation means and property.
- NOTICES
17.1 Notices under each Agreement must be in writing and sent to the mail or e-mail address specified on the website (unless otherwise notified by seven days’ prior notice).
17.2 Notices sent by mail are deemed to have been served 10 days after posting to or from a place abroad, and three days after posting within the United Kingdom.
- GOVERNING LAW
Each Agreement is governed and construed by UK law, and the parties agree to the non-exclusive jurisdiction of the UK courts.
