KVKK Information and Clarification Text

Eylül Translation Consulting and Publishing Services Ltd. (hereinafter referred to as the “Company”), acting as the “Data Controller,” informs you, in accordance with Article 10 of the Personal Data Protection Law No. 6698 (“KVKK”), about the purposes of processing your personal data (“Personal Data”), the methods of collection, legal grounds, and your rights. The processing of your personal data is based on legal grounds such as “the will to make public,” “the necessity of processing personal data of the parties to establish or perform a contract,” and “the necessity of data processing to establish, exercise, or protect a right.” The processing is carried out in compliance with the principles of protecting fundamental rights and freedoms, particularly the right to privacy, and in accordance with the Regulation on the Processing of Personal Health Data and Ensuring Privacy, Ministry of Health regulations, and other relevant legislation.

a) Data Controller and Representative
In accordance with the Personal Data Protection Law No. 6698 (“Law No. 6698”), your personal data may be processed by the Company as the data controller/data processor within the scope explained below.

b) Scope of Clarification
This clarification text covers all natural persons whose personal data are processed, either automatically or non-automatically as part of any data recording system, including Company Stakeholders, Company Officials, Business Partners/Suppliers, affiliates, Employees, Employee Candidates, Visitors, Company and Group Company Customers, Potential Customers, and Third Parties.

c) Purposes of Processing Personal Data
Personal Data is processed in compliance with the law and the purpose of the Law, for the following purposes:

  • Communicating with Personal Data Subjects and managing requests, offers, and complaints.
  • Measuring patient satisfaction and ensuring the flow of information regarding any questions or complaints within the scope of our health services.
  • Protecting public health, preventive medicine, medical diagnosis, treatment, and care services.
  • Informing you about appointments if you make one.
  • Informing third parties or customers about campaigns, discounts, benefits, conditions, and pricing, subject to the Data Controller’s instructions.
  • Confirming your relationship with contracted institutions and organizations.
  • Sharing information requested by private insurance companies or the Social Security Institution for the financing of your health services, tests, diagnosis, and treatment expenses.
  • Planning and implementing human resources procedures and policies.
  • Planning, executing, and managing commercial partnerships and strategies.
  • Ensuring the legal, commercial, and physical security of the Company and its business partners.
  • Sharing information requested by the Ministry of Health and other relevant public institutions and organizations in accordance with legal regulations.
  • Ensuring the continuity of business activities and operations.
  • Sharing information with legally authorized institutions and organizations.

Personal Data will be processed within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698 for the determination and implementation of the Company’s commercial and business strategies.

d) To Whom and for What Purposes Processed Personal Data May Be Transferred
Your collected personal data may be shared with the following parties for the purposes of providing you with the services offered by our Company, ensuring the execution of our human resources and health tourism policies, ensuring the legal and commercial security of the Company and its business partners, and determining and implementing the Company’s commercial and business strategies:

  • Suppliers, shareholders, affiliates, legally authorized public institutions, and private individuals within the framework of Articles 8 and 9 of Law No. 6698.
  • Health institutions, laboratories, medical centers, ambulance services, medical device providers, and health service providers, both domestically and internationally.
  • Legally authorized persons, such as independent audit firms, who perform transactions on our behalf.
  • Public institutions and organizations, such as the Ministry of Health, Social Security Institution, General Directorate of Security, and other law enforcement agencies, when legally required.
  • Third parties providing consultancy and support services, such as storage, archiving, IT support, security, and call center services.
  • Banks, financial institutions, law firms, consultancy firms, and other related parties for legal, tax, and similar purposes.
  • Advertising agencies and advertisers, where anonymized data may be shared for the purpose of tailoring advertisements to target audiences.

e) Sharing of Personal Data with Third Parties Domestically and Abroad
Your personal data may be shared with third parties domestically and abroad, including companies to which our Company provides services, human resources consultancy firms, financial institutions, IT companies, notaries, private insurance companies, health institutions, professional consultants, lawyers, accountants, occupational health and safety organizations, and business partners.

f) Method and Legal Grounds for Collecting Personal Data
Your personal data may be collected through automatic or non-automatic methods, including offices, locations, branches, call centers, websites, social media platforms, mobile applications, and other technical means, either verbally, in writing, or electronically. Your personal data will be processed as long as you benefit from the Company’s services and may be updated accordingly. Personal data may also be processed when you use our call center or website, visit our Company or website, or participate in events organized by the Company.

Identification information such as name, surname, date of birth, place of birth, citizenship, and ID number Processed in accordance with Article 5/2-a of Law No. 6698, as required by the Tax Procedure Law No. 213 and the Turkish Commercial Code No. 6102.
Contact information such as email, address, and phone number Processed in accordance with Article 5/2-c of Law No. 6698 for the purpose of fulfilling contractual obligations and communication.
Service history Processed in accordance with Article 5/2-f of Law No. 6698 to improve service quality and provide a better experience.
Special categories of personal data, such as health data Processed in accordance with Article 5/2-f of Law No. 6698 for the purpose of medical diagnosis, treatment, and care services.
Voice recordings Processed in accordance with Article 5/2-f of Law No. 6698 for customer satisfaction and dispute resolution.
Camera recordings Processed in accordance with Article 5/2-f of Law No. 6698 for security purposes.

How Long Are Personal Data Retained?
Your personal data will be retained for a maximum of 10 (ten) years, in accordance with Article 182 of the Turkish Commercial Code and Article 146 of the Turkish Obligations Code, unless longer periods are required by law. Camera recordings are retained for a maximum of 1 (one) year.

g) Rights of the Personal Data Subject under Article 11 of Law No. 6698
The Company informs you of your rights under Article 10 of the Law and provides guidance on how to exercise these rights. Personal Data Subjects have the following rights under Article 11 of the Law:

  • Learn whether your personal data is being processed.
  • Request information if your personal data has been processed.
  • Learn the purpose of processing your personal data and whether it is used in accordance with its purpose.
  • Know the third parties to whom your personal data is transferred, domestically or abroad.
  • Request the correction of your personal data if it is incomplete or inaccurate.
  • Request the deletion or destruction of your personal data if the reasons for processing no longer exist.
  • Request that the third parties to whom your personal data has been transferred be informed of the corrections or deletions.
  • Object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems.
  • Request compensation for damages if you suffer damage due to unlawful processing of your personal data.

Personal Data Subjects may submit their requests regarding the above rights by filling out the Application Form available at https://healthlife.com.tr/ and sending it to the Company via the following methods:

  • Delivering a wet-signed copy in person to the address: Dr. Adnan Büyükdeniz Cad. 2 Blok No:4/2 Ümraniye-İstanbul.
  • Sending the form signed with a secure electronic signature under the Electronic Signature Law No. 5070 to the registered email address.
  • Sending the form via the email address previously notified to the Company and registered in the Company’s system.

Third parties may submit requests on behalf of Personal Data Subjects only if a notarized power of attorney is provided.
